Kyrgyzstan: the Parliament is recommended considering project of the Constitution only after Constitutional court’s conclusion

On Friday, April 13, session of Jogorku Kenesh (national parliament) committee on constitutional legislation, state structure and legality, headed by deputy Iskhak Masaliev took place, AKI Press informs.

A draft law on Kyrgyz Constitution modification, presented by Prime minister Almazbek Atambaev and signed by President Kurmanbek Bakiev was considered.

According to the draft law, key amendments touch on Prime minister appointment to the post and formation of the government. The head of the government nominee is brought by deputy groups and fractions and accepted by parliament ballot by majority of voices. In case the parliament does not present the nominee within five working days from the moment of passing the law, the President himself appoints the head of the cabinet from nominees, presented by deputy fractions and groups. As A.Atambaev told, he proposed this amendment to the draft law personally.

Members of the government are presented by the Prime minister and appointed by the President. The President appoints heads of power departments independently.

Atambaev explained that in case the parliament passes the draft law, the operating government resigns and becomes a caretaker administration before the cabinet is formed under the passed law.

According to the changes, being brought, Kyrgyz parliament consists of 105 members; not less than 50 percent should be elected under party lists.

Enactment, naming Kyrgyzstan the secular state also appears in the draft. Operating Organic law does not comprise such enactment; it was excluded while passing the law last December.

As IA 24.kg informs, the committee forwarded the draft law for consideration of parliament chamber, having made a clause, that the document could be considered only after a conclusion of Constitutional court. Thus the parliament is recommended to approve judges at the soonest in order that Constitutional court had a quorum at last.

It is necessary to note, that the opposition has its own variant of the Constitution, however, as Iskhak Masaliev informed, until now is not brought in parliament.

Let us remind that on April 12 deputies - members of Incorporated front and movement "For reforms" declared they were determined to bring joint project of the Constitution in parliament as a group of Jogorku Kenesh deputies’ initiative.

"The opposition is in its right to bring in a draft law, but at present for consideration of committee the only draft with amendments to Kyrgyz Constitution, brought by President Kurmanbek Bakiev on April 10, was forwarded. Any other projects of the Constitution have not been brought in the committee yet", - AKI Press quotes Masaliev’s words.

To forward the project of the Constitution from the side of opposition for consideration of parliament, signatures of 38 Jogorku Kenesh deputies are required.
